Terms of Service

These Terms of Service govern your access to and use of the Fazen Design & Creative website, creative services, digital products, project dashboard, client workspace, communications, and related offerings.

By accessing our website, requesting a project, purchasing a service or digital product, using a project workspace, or communicating with Fazen about paid work, you agree to these Terms. If you do not agree, please do not use our website, services, products, or project tools.

Fazen Design & Creative provides graphic design, brand identity, social media design, presentation design, marketing and print collateral, creative support, digital templates, brand resources, and related design services.

Our services may be offered through project packages, custom proposals, checkout pages, invoices, direct communication, or client workspaces. Specific details for each purchase or project may vary depending on the agreed scope.

You must be at least 18 years old to purchase from Fazen or use our project dashboard. If you use Fazen on behalf of a company, brand, organization, or client, you confirm that you have authority to accept these Terms on their behalf.

You are responsible for ensuring that the information you provide to Fazen is accurate, complete, current, and legally permitted for your intended use.

The scope, deliverables, pricing, estimated timeline, revision terms, and included files for each project are defined by the relevant package, proposal, invoice, checkout page, written agreement, or project communication.

Fazen will make reasonable efforts to deliver work professionally and within the communicated timeline. Timelines may change if project requirements change, required materials are missing, feedback is delayed, approvals are delayed, or additional scope is requested.

A clear creative process depends on accurate inputs, timely feedback, and proper rights to the materials used in the work.

• You are responsible for providing accurate briefs, brand information, content, references, files, access, and project requirements needed to complete the work.
• You must provide timely feedback, approvals, and decisions. Delays in communication may affect delivery timelines and project scheduling.
• You confirm that you have the legal right to provide and use any logos, images, copy, trademarks, fonts, brand materials, product information, or third-party assets you share with Fazen.
• You are responsible for reviewing deliverables before approval, publication, printing, advertising, distribution, or commercial use.

Fazen may provide a private project dashboard or client workspace for managing briefs, tasks, files, comments, assignments, status updates, approvals, and project communication.

The dashboard is a private workspace operated by Fazen. It is not an external designer marketplace. Fazen Team members, assigned PICs, and approved helpers may access project information only as needed to support the relevant work.

• You must not share workspace access with unauthorized people or attempt to access projects, files, accounts, or systems that do not belong to you.
• You must not upload malware, harmful files, unlawful content, infringing materials, misleading information, or content that violates these Terms.
• You are responsible for keeping your login credentials secure and notifying Fazen if you suspect unauthorized access.

Payments may be processed through Paddle or another payment provider. Where Paddle is used, Paddle may handle checkout, payment authorization, receipts, applicable taxes, payment security, subscription or order records, refunds, and chargeback support according to its own terms and policies.

You agree to provide accurate billing and payment information. Fazen may receive transaction metadata needed to fulfill your order, provide support, maintain records, prevent fraud, and resolve payment-related issues.

Prices may be listed in one or more currencies and may exclude taxes unless stated otherwise. Applicable taxes, fees, or payment provider charges may be calculated during checkout or invoicing.

When you purchase a Fazen digital product, template, brand resource, or downloadable file, you receive a limited, non-exclusive, non-transferable license to use it according to these Terms and any license terms shown with the product.

Unless a product page or written license says otherwise, you may use purchased digital products for your own brand, internal business use, or client work. This permission does not transfer ownership of the underlying template, source resource, or Fazen intellectual property.

• You may not resell, redistribute, sublicense, publicly share, upload to template marketplaces, or offer the original digital product as a standalone file or competing resource.
• You may not claim Fazen templates, resources, or source files as your own standalone product.
• You are responsible for ensuring that your use of a digital product fits your industry, platform, legal requirements, and brand needs.

After full payment is received, the client owns the final approved deliverables prepared specifically for that client, subject to these Terms and any third-party license restrictions.

Fazen retains ownership of unused concepts, rejected directions, drafts, working files, source files, internal systems, project methods, templates, design frameworks, pre-existing materials, and creative process materials unless a written agreement states otherwise.

Editable source files are included only if they are expressly listed in the package, proposal, invoice, checkout page, or written agreement. If source files are not listed, Fazen is not required to provide them.

Unless you request confidentiality or a separate non-disclosure agreement applies, Fazen may display final approved work, project outcomes, brand visuals, and general project context in our portfolio, website, social media, proposals, presentations, or promotional materials.

Fazen will treat non-public client materials with reasonable care and will avoid disclosing sensitive project information that is clearly confidential. If a project requires stricter confidentiality, please tell us before the project begins so we can confirm the requirements in writing.

Included revisions follow the package, proposal, invoice, checkout page, or written agreement for the relevant project. Additional revisions, new directions, rushed timelines, extra formats, new deliverables, or changes outside the original scope may require additional fees.

Once a deliverable is approved or delivered as final, later changes may be treated as a new request or a new project. You are responsible for checking names, copy, dates, prices, technical details, legal requirements, and other content before approval or publication.

Cancellations and refunds are handled according to Fazen's Refund Policy, the specific purchase terms, the project status, and any applicable payment provider rules.

Because creative services involve custom work, planning, reserved production time, and project-specific execution, refund eligibility may vary depending on whether work has started, files have been delivered, digital products have been accessed, or a custom project has already been prepared.

You agree not to use Fazen's website, services, products, dashboard, or deliverables for unlawful, harmful, abusive, fraudulent, misleading, infringing, or unauthorized purposes.

• You may not use Fazen to create or distribute content that violates applicable law, third-party rights, platform policies, payment provider rules, or intellectual property rights.
• You may not interfere with, reverse engineer, scrape, overload, attack, bypass, or compromise our website, dashboard, checkout, files, or systems.
• You may not submit false payment information, abusive chargebacks, unauthorized purchases, or misleading project information.

Projects may involve third-party materials or tools, such as fonts, stock assets, plugins, software, AI-assisted tools, payment providers, hosting providers, or platform-specific services. These third-party materials may be subject to their own licenses, limitations, and terms.

You are responsible for third-party assets you provide. Fazen is responsible for using reasonable care when selecting or recommending third-party materials, but we do not control third-party platforms, policies, pricing, availability, or future changes.

Fazen may use AI-assisted tools as part of our creative workflow for ideation, drafting, exploration, production support, research organization, or efficiency. These tools support the process, but Fazen maintains human creative direction, review, and decision-making over the work we deliver.

Please do not provide highly sensitive, regulated, or confidential information unless it is necessary for the project and we have agreed on the handling requirements. When a project requires stricter limits on tool usage, those requirements should be confirmed in writing before work begins.

Fazen provides creative work, design support, and digital resources with professional care, but we do not guarantee specific commercial outcomes. Results such as sales, revenue, conversion rates, ad performance, follower growth, platform approval, customer response, or business growth depend on many factors outside our control.

Our website, dashboard, digital products, and services are provided on an as-available basis. We may improve, update, suspend, or change parts of our offerings when needed for security, maintenance, compliance, product direction, or business operations.

To the fullest extent permitted by applicable law, Fazen is not liable for indirect, incidental, consequential, special, punitive, or business losses, including lost profits, lost revenue, lost data, lost opportunities, reputational harm, or platform-related consequences.

To the fullest extent permitted by applicable law, Fazen's total liability for any claim related to a product, service, project, or transaction is limited to the amount you paid to Fazen for the specific product or service giving rise to the claim.

Fazen may suspend or terminate access to services, products, files, checkout, or project workspaces if we reasonably believe there is unpaid billing, fraud, abuse, security risk, unlawful activity, intellectual property infringement, violation of these Terms, or misuse of our systems.

Termination does not remove obligations that should reasonably survive termination, including payment obligations, ownership restrictions, confidentiality, acceptable use, limitation of liability, and dispute provisions.

Your use of Fazen is also governed by our Privacy Policy, which explains how we collect, use, store, and share personal information, project materials, dashboard activity, and payment-related data.

These Terms are governed by the laws of Indonesia, except where mandatory consumer protection laws in your location require otherwise.

If a dispute arises, you agree to contact Fazen first at fazensocial@gmail.com so we can try to resolve the issue in good faith before either party takes formal action.

Fazen may update these Terms from time to time to reflect changes in our services, products, dashboard, payment setup, legal requirements, or business operations. The effective date at the top of this page shows when these Terms were last updated.
